Will Dr. Nir become the first leftist indicted for incitement to murder?

Deputy State Prosecutor Shai Nitzan has asked the police on Thursday to investigate a Ben Gurion University professor due complaints that have been made over an inciting web post.

"I call on the world to come help break these scoundrels' necks," the lecturer wrote. The post was accompanied by a video clip that showed some of the marchers chanting anti-Arab slogans.

According to a Justice Ministry statement, Nitzan said that the post warranted an investigation on suspicion of incitement to violence.

Ben Gurion University responded by saying that "Dr. Eyal Nir published the post on his Facebook page as a private citizen. The university has nothing to do with the issue, which is why the issue must be discussed in the appropriate forum."

Deputy State Prosecutor Shai Nitzan has asked the police on Thursday to investigate a Ben Gurion University professor due complaints that have been made over an inciting web post.

The complainants claimed that Dr. Eyal Nir posted a statement on his Facebook page that called for violence against right-wing activists who marched through the capital with flags on Jerusalem Day.

"I call on the world to come help break these scoundrels' necks," the lecturer wrote. The post was accompanied by a video clip that showed some of the marchers chanting anti-Arab slogans.

According to a Justice Ministry statement, Nitzan said that the post warranted an investigation on suspicion of incitement to violence.

Nir wasn't available for comment.

'Post was reasonable'

MK Ofir Akunis, who demanded the Attorney General launch an inquiry into the case, said: "Justice in Israel must apply to everyone, and this phenomenon, in which the Left's incitement to violence against the Right has gone unaddressed and ignored for years, must stop and be prosecuted to the fullest extent of the law."

In his post, Nir described the right-wing activists as "a gang of bandits that swarms our country." The status drew a flurry of criticism.

One Facebook user commented on the thread saying that a right-wing professor would be fired "even before he could hit 'send'" if he made the same comment; another commentator claimed that the post constitutes a criminal offense.

Nir said in June that he thought that his post was reasonable considering the circumstances.

"During the Jerusalem Day march a gang of a few dozen bullies walked through the city's Arab streets shouting 'death to Arabs, death to leftists, burn their villages,'" he wrote.

"I believe that the response of any reasonable, peaceful and just individual should be that they must be prevented from acting out their threats such as in terrorist activities dubbed 'price tag'. I believe my cry to stop them is reasonable, and actually the silence from society and the Israeli system in the face of this incitement to terrorism and terror itself is what should be written about in the papers."

Deputy State Prosecutor Shai Nitzan instructed the police to open a criminal investigation against Dr. Ayal Nir, a lecturer at Ben- Gurion University in Be'er Sheva, over a status on his Facebook page in which he called on the world to "break the necks of right-wing activists."

Nir faces possible charges of incitement of violence.

The Be'er Sheva lecturer's status was in response to the right-wing Jerusalem Day "Rikud Degalim" flag procession held this year in East Jerusalem, in which activists yelled "Death to the Arabs" as they marched through the Old City.

"I call on the world to come and help break these scoundrels' necks," Nir posted as his status in May of this year, after which he posted a video showing the marchers yelling "Death to the Arabs".

The Ministry of Justice said that despite the offensive slogans that were heard on the video, Nir's calls to break their necks warranted a criminal investigation into incitement of violence.

"Dr. Nir published his comments as a private individual, on his personal Facebook page. The university does not take a side in the matter, and therefore justice should be sought in appropriate legal forum," Ben-Gurion University said in a statement.

'Ben Gurion a Greenhouse for Radical Left'
Zionist groups welcome decision to investigate professor for incitement, call on universities to act.

Zionist groups expressed satisfaction Friday over the decision to investigate Professor Eyal Nir for incitement. Nir called on the public to attack Zionist youth dancing in the streets on Jerusalem day and "break their elbows."

The Land of Israel Legal Forum said the decision was a good one, but questioned why prosecutors had waited several months to look into Nir's statements. If a right-wing professor had called to attack leftist demonstrators, it would have taken the Justice Ministry just days to decide to open an investigation, Forum activists said.

"The wheels of justice turn slowly and with astonishing selectivity," said forum head Nachi Eyal.

The Im Tirzu student group warned that Nir is not alone. "Ben Gurion University has been a greenhouse for the extreme left for some time," activists said, mentioning notoriously anti-Zionist professors Niv Gordon and Oren Yiftahel among others.

The university has the responsibility to act immediately against professors who use their publicly-funded positions to spread extreme-left incitement, the group said. "A lecturer must not continue to work in the university while inciting to murder."

MK Ofir Akunis (Likud) said the decision was a sign of a welcome turn-around. "For years, the issue of leftist incitement against the right has been ignored," he said. "It must be handled with the full force of the law."
